Baker Tilly’s Competence Center Restructuring has guided independent mail services provider dvs and its delivery subsidiary xendis through debtor-in-possession proceedings to a successful close. A strategic investor is coming on board, and around 520 jobs have been preserved.

Baker Tilly has advised dvs – Deutscher Versand Service GmbH (“dvs”) and its subsidiary xendis GmbH (“xendis”) on their successful restructuring. Throughout the roughly seven-month, now-concluded self-administration proceedings (Eigenverwaltung, the German equivalent of debtor-in-possession proceedings), the firm’s Competence Center Restructuring acted as advisor to both companies.

dvs is one of the largest players in Germany’s independent letter market, where it competes with Deutsche Post. Following unanimous creditor approval, the insolvency plans have become final and binding. The new strategic investor is Deutschlandversand GmbH & Co. KG, backed by a consortium led by the Madsack Media Group. The transaction secures around 520 jobs across the group, and customers will see no interruption to service.

The Baker Tilly team, led by Tobias Kampmann, was closely involved in the restructuring from day one. The team helped design the restructuring measures, led negotiations with mail carriers and customers, and managed the companies’ liquidity. The team comprised Kampmann’s colleagues Timo Henning, Junior Manager, Alexander vom Scheidt, Junior Manager, and Nick Paschedag, Consultant.

“Robust planning, transparency for all stakeholders and stable operations are indispensable in self-administration. I’m delighted we were able to play a key role in supporting dvs and xendis. Excellent collaboration among all parties was another key factor in our success,” said Tobias Kampmann, Director, Competence Center Restructuring, Baker Tilly.

Baker Tilly worked closely with managing director Michael Mews and the other parties involved. Dr. Markus Kier (Piepenburg Rechtsanwälte) acted as court-appointed monitor (Sachwalter) in both proceedings, Dr. Marc Oberhardt (RSM Ebner Stolz) served as legal counsel to management, and Jonas Eckhardt (Falkensteg) led the M&A process.
